AutoBuy Terms of Use

These Terms of Use govern your use of AutoBuy, a feature of the HotStock app

Introduction

Welcome to AutoBuy, a feature of the HotStock iOS and Android app. By subscribing to and using AutoBuy, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the service. These terms apply in addition to HotStock's general Terms of Use. In the event of a conflict, these AutoBuy terms take precedence for AutoBuy-related features.

Description of Service

The AutoBuy tier is a subscription-based feature that:

  1. Includes Premium tier features (when a stock notification is sent, it is sent to subscribers first, before it is sent to free HotStock users),
  2. Allows you to add more products to your My Alerts list,
  3. Provides automated checkout processes on specific third-party e-commerce retail websites. These supported retailers are listed under the "Supported retailers" paragraph at the top of the AutoBuy Details page (in the HotStock app left-menu > Upgrade > see "More details" and AutoBuy FAQ) that you see when choosing to upgrade. This list of supported retailers is dynamic and may change depending on retailer changes.

HotStock and AutoBuy are facilitators only. AutoBuy operates as an intermediary service that interfaces with third-party retailers' websites and systems. We do not own, control, or guarantee availability or performance of any third-party retailer, product or purchase.

No Guarantee or Warranty

You acknowledge and agree that:

  • No Purchase Guarantees: We do not guarantee successful purchases, price accuracy, notifications, or notification speed.
  • Stock Limitations: Product availability is managed by third-party retailers, stock is often limited, regional, and can sell out rapidly. We have no control over retailer inventory, stock levels, product availability, or demand.
  • Third-Party Dependencies: Our service relies on third-party retailer websites, systems, and policies which may change without notice. AutoBuy may be affected by retailer changes, user device limitations, internet connectivity, platform outages (including Apple/Google services), or additional retailer checkout measures (e.g. payment/CVV confirmation, login re-confirmation, expiring cookies).
  • High-Demand Products: Some products (including but not limited to limited releases, collectibles, and high-demand items) may be virtually impossible to purchase at times of extreme competition from other buyers and automated systems
  • Technical Limitations: Retailer websites may implement anti-automation measures, experience disruption or downtime, or change their systems in ways that affect AutoBuy functionality

ALL USE OF HOTSTOCK AND AUTOBUY IS “AS IS” AND AT YOUR OWN RISK.

Service Availability

  • AutoBuy is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • We may suspend or modify the service for maintenance, updates, or other operational reasons
  • Some retailers may block or restrict automated purchasing tools

User Responsibilities

By using AutoBuy:

  • You agree to review the linked product and confirm it is the correct item you desire before enabling AutoBuy. The links do not signify that we endorse the website(s) or app(s).
  • You are responsible for maintaining accurate and up-to-date login connections, credentials, and payment methods for retailer accounts.
  • Keep your retailer account information and AutoBuy connection current and accurate.
  • Use the service in accordance with all applicable laws and retailer terms of service. You agree to comply with all terms and conditions of any third-party services you access via AutoBuy.
  • Use AutoBuy as intended for increased success (keeping app active/foreground with the screen unlocked when monitoring for purchases).
  • Do not abuse or misuse the AutoBuy features. AutoBuy is intended for genuine fans who plan to use the product themselves, not for resellers or those attempting to purchase the same product multiple times.
  • As such, each item's quantity is limited to one per purchase. Using AutoBuy to attempt to buy multiple units of the same product is considered abuse and may result in termination of access. Only enable AutoBuy on one device at a time to avoid issues with automated retailer checkout processes.

Limitations of Liability

To the fullest extent permitted by law, LiteBox Ltd and its affiliates shall not be liable for:

  • Loss of opportunity, missed or incorrect purchases, data loss, retailer policy changes, third-party system failures, third-party retailer account loss, or indirect damages.
  • Errors, delays, cancellations or failures of purchases or notification/email delivery.
  • Actions or inactions of any third-party retailer.

To the maximum extent permitted by law:

  • Our total liability to you is limited to the amount you paid for your AutoBuy subscription
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not responsible for missed purchase opportunities, retailer policy changes, or third-party system failures
  • You use AutoBuy at your own risk

If you are dissatisfied with the service, your sole remedy is to discontinue use and terminate the subscription via your app store, if applicable.

Subscription & Billing

  • AutoBuy is billed as a recurring monthly subscription and subject to app store policy (automatic renewal unless cancelled).
  • You can manage or cancel your subscription at any time through your app store (Apple/Google).
  • Refunds are at our discretion unless otherwise required by app store policy. This does not affect any statutory rights you may have under applicable law.

Governing Law and Regional Variations

These Terms shall be governed by and construed in accordance with the laws of England and Wales, unless otherwise required by local law.

United States Residents: Disputes are subject to binding arbitration and waiver of class actions, as detailed below in the Dispute Resolution section.

Canadian Residents: If you reside in Canada, these Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, unless otherwise required by applicable provincial law. You agree to resolve any disputes arising from your use of HotStock through individual arbitration, to the extent permitted by applicable law. Nothing in these Terms limits your rights under provincial consumer protection legislation.

Dispute Resolution and Arbitration (U.S. and Canadian Users)

If you are a resident of the United States or Canada, you agree that any dispute, claim, or controversy arising out of or relating to your use of HotStock (including AutoBuy), these Terms, or your relationship with LiteBox Ltd shall be resolved through final and binding arbitration on an individual basis.

This applies to all disputes including those based in contract, tort, statute, fraud, or misrepresentation, and survives termination of these Terms.

The arbitration shall be administered by the American Arbitration Association (AAA) or, for Canadian users, another mutually agreed-upon arbitrator or forum. Arbitration may be conducted virtually.

Class Action Waiver: You and LiteBox Ltd agree that disputes may only be brought in an individual capacity, not as a class member or representative. You waive any right to participate in a class or representative proceeding.

Exceptions: You may still file a claim in small claims court, or if applicable law prohibits arbitration (e.g., certain provincial laws in Canada), this section will not apply to the extent of that prohibition.

Opt-Out Option: You may opt out of this arbitration agreement by sending written notice to us via our Contact Form within 30 days of your first acceptance of these Terms. Your opt-out notice must include your full name and clearly indicate your intent to opt out of arbitration. Opting out of arbitration will not affect any other provisions of these Terms.

Dispute Resolution and Arbitration (UK and International Users)

If you are not a resident of the United States or Canada, any disputes or claims arising out of or relating to these Terms, AutoBuy, or HotStock will be governed by the laws of England and Wales. You agree that such disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by local law.

Prohibited Uses

You may not:

  • Violate any retailer's terms of service
  • Use AutoBuy for illegal purposes
  • Attempt to reverse engineer or exploit the service
  • Share your subscription access with others
  • Use AutoBuy in ways that could harm our systems or other users

Termination

We may terminate your AutoBuy access for:

  • Violation of these terms
  • Suspected fraudulent activity
  • Technical or business reasons
  • Non-payment or Ccncellation of subscription fees

Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of HotStock or AutoBuy after changes constitutes acceptance.
